Is bird dog legal in the state of Florida?

i want to start a career in real estate investing, one piece advice that i was told is that bird dog is a good way to start out to make money in spare time. but some say that it may or may not be legal depending on the state you live in.

In Florida, it's illegal to ACCEPT a fee for finding properties but not to GIVE a fee. Legal weirdness. You can option properties and then assign the option for a fee or find a mentor to work with. There are several real estate investor associations in your area.

Real estate agents make their money finding properties for buyers and finding buyers for properties. Bird dogs are not well liked by agents for good reason. :-)

Real estate agents are required to be licensed in order to protect the general public.

In Florida, if a person performs any of the eight services of real estate for another, for a fee, that person must be licensed by the state. The eight services of real estate are:

- Advertise
- Buy
- Appraise
- Rent
- Sell
- Auction
- Lease
- Exchange

The textbook "Florida Real Estate Principles, Practices & Law" (35th Edition), by Linda L. Crawford, states on page 34:

"it is a violation of license law to share a commission with or to pay a fee or other compensation to an unlicensed person for the referral of real estate business clients, prospects, or customers."

While you can buy, sell, exchange, or lease property for yourself, without obtaining a real estate license, you may decide you'd rather get the license and help others too.

You can, however, "bird-dog" for another agent if you have your license and you have placed it under a broker. But if you've gone to.. that much trouble, you would probably want to just act as the agent for any clients you find.

can you bird dog for an investor who's looking to purchase a property, would a real estate license be needed to do so?

are you asking if you can earn commissions or referral fees for finding buyers and sellers for licensed real estate agents? If so, the answer is absolutely not in Florida. It is unlicensed activity and can be prosecuted in court.

It would not be for real estate agents but for investors.
