Just one has to declare the property their primary residence. I've certainly run into people who try and scam the system by having one spouse claim their home in Florida as primary and the other claim a home in another as primary. if you are trying to go this route, do get good tax advice.

Normally when you are married both persons are living in the home but, you can have one of you be a primary resident. Because you are married you both should be able to receive the homestead rebate.
