In my letter from the sellers attorney, he states I have lost my 40K in earnest money (purchase price of 180K) and am being evicted based on a lease.

The lease was a one year lease that lapsed in 2005...no auto renewal clause was in the lease. This was a legal document on the letter head of the attorney. My eviction is for Feb 1 of 2012.

Not only is there incomplete information here,
but you are asking some legal questions:
I just told someone else;
Realtors do not do LEGAL.
Attorneys do LEGAL.
