If your offer has been accepted and in escrow but there is pending litigation with the previous tenant, owing back rent does it affect escrow process

It could, find out if someone has filed what is called a "Lis Pendens" against the property. J.R. Thrasher

It shouldn't. The escrow will pay to you any security deposits from current tenants (because when they move out, you will need to refund that money). Any prior non-payment of rent is the previous owner's problem. My recommendation, however, is to make sure that tenant is gone from the property before you take ownership. Why transfer a headache?
