I'm seeing a lot of homes listed as new construction but they were built 10 years ago? How can agents list homes new when they clearly are not?

I live in California, but I have heard a lot about the over building in Florida. There was a lot of speculating going on. My guess would be that the homes never sold. So they are not as much new construction, as they are never sold or lived in. Either that or there was a mistake in the age entry on the MLS.
