How long does probate take in Queens County?

A week after our offer was accepted and the contract was started we find out that the house has become an estate sale (even though we we told it was not by the seller's broker at the first showing - but that's besides the point now)...

We are now waiting for probate --- we've been waiting for approx. 6 weeks now and the seller's broker has been hounding us every day to start the mortgage/closing process. Our attorney has told us not to start the process until the letters of estate has been issued.

Does anyone know how long probate process usually takes in Queens County? Assuming no one contests the will, etc. Has anyone have any experience with this sort of situation?

Your attorney can best answer as to the lenght of time; generally it will depend on how backlogged probate cases may be in the county, any objections to the will, were all heirs notified, etc.

My attorney told me that probate takes 6 to 9 months in Queens.

My attorney had told us it would be about 4 weeks -- but it's been 6 already. We are just concerned that it will drag on for months and meanwhile the house is not being maintained since the owner has passed away and there is no longer anyone living in the house
