During our home inspection we asked for a radon test, which came back with elevated levels. We were given

the test results the day after our week of due diligence was over. Our agent is now saying that its our problem since our due diligence is over. I don't think that is fair we did the test during the allotted time, I can't help if it takes 2 days to run the test and another 2-3 to get the results back.

I am I right or should I just suck it up?

I am a novice to real estate law, but it seems the common-sense thing to do would have been to announce during your due diligence period that the radon tests matter. For example, if you get an inspection done during due diligence that unveils a leaky roof, you obviously don't have to repair it during due diligence. However, if you previously agreed that the roof needs to be fixed before closing then it has to be done before closing...not before the window closes on the due diligence period.

Hello Sean,

I do have a few questions. Is it customary in your area to only have a 7 day option period? Is your area prone to high Radon levels? Did the person performing the radon test advise you how long it would take? Most importantly, when you made the offer didn't the RE Agent ask what your intentions were for inspections and other due diligence actions and ensure that a more than sufficient option period was requested in the contract?
