Does one need a lawyer to buy a home?

No, not really but it is a lot safer to have one draw up the correct deed and do the recording to make sure it is done correctly. In many states I, as a Broker, can close a sale but I never felt the need to do it. The lawyer fee is not that much and if you use a title company they get a lawyer to draw up a new deed.

Better safe than sorry! If your planning to purchase a property a real estate attorney will ensure that the property your purchasing has a title free of any leins or emburances. And while a title company can also perform the same tasks, using an attorney would be the best choice. Like I said better safe than sorry! I work with a real estate attorney for many of my closings. He's really good and his name is Joel Lavender, located in Rio Vista in case your looking for an attorney.

It's all depends on the buyers level of comfort: the title co. will handle all the paperwork as required by law, and the co.' attorney will answer all legal questions... once you are issued a title commitment you are good to go....

To protect yourself I would recommend that all contracts are done with the assistance of an attorney or title company to make sure that they are legal binding agreements.
