Does anyone have any experience with the Philadelphia Court Eviction Process. I have a tenant that moved in

Tenant moved in w 2 mos rent. I gave her free rent for Mar. because repairs were running slow. Minor repairs. Come April she says she lost her wallet while getting out of a taxi, come May, the social security (SSI) papers were mailed to her former address. No rent yet. Towards the end of May, she leaves me a message indicating that she sent the rent & did I get it. The mail only takes two days from PA to NY. No rent-I sent her an eviction notice- She called my cell phone 10 times. Why didn't I call her and tell her I didn't get the check blah..She calls me back a week later to tell me she's not mailing the check again she doesn't want to go through that again. She calls me again with can you come pick it up or send some one. I did send someone but on both trips-her boyfriend indicated she wasn't home. She didn't call me to say I understand someone stopped by...I last sent her 2 self-addressed stamped envelopes for;she left a vm replying that she'd mail them this way. No rent

what will happen if you just take the tenant out yourself and change the locks? I have a situation that a tenant moved in a studio with 5 children without a lease or permission from us and everyone is telling us we have to get her evicted which is a long process that we do not want to take. It isn't fair that its so much trouble to get a tenant out so just like she did things illegal so am I...

You need to get the eviction process started now. It took almost two years for this process to finally be over. My "squatter" as I call him, kept filing petitions and the court system is extremely slow....
Eviction will FINALLY take place after all this time.... BUT, to add insult in injury, the courts say I will need to move all his personal belongings into storage for 30 days (at my expense)..... So, I am not only paying a law firm, but I am paying for a locksmith, moving company and storage for 30 days. What's wrong with this picture ? Amazing that you can own a home and have to pay thousands to get someone out.......
Never saw a penny in 3 years.....

hopefully, you have a month to month lease. sounds like someone is playing games with you. Start eviction process NOW. Send her a letter notifying her that you are terminating the lease and give her the amount of time listed in the lease. I had a tenant that was a "serial player in the tenant game" and she kept filing appeals. She ended up staying in my house free from June 2008 until January 09.

The answer to this is very simple you must file to have her evicted it only get wores unless she hit the lottery. My company will file if the tenant is ten days late unless they call and tell me they are coming in with the full rent not part I want it all they didn't live part of the month. Philly is a touch area for evictions for two reasons:

1. The legal system - Philly is slow and convaluted and the courts are taxed (you know how many shootings there are in Philly?)
2. The tenants - your demographic is not good for eviction, your average tenant in Philly is a strong-willed (potentially ign'ant) fighter and they will usually fight you to the last second, even when they know they are wrong.

I would enlist professional help. I've used Evictions Unlimited before just beware that evictions do take at least 6 weeks (usually 2-3months).

Yes you can file for an eviction for non-payments of rent, key word being File. You must notify the tenant in writing, within 10 days of filing, notifying them that you will be filing an eviction case. This notice should give them a time parameter for vacating the property. If the tenant does not vacate in the alloted time, you then have to file a tenant/landord complaint with the courts. You will then get a court hearing at which time both parties will be heard.
