Lu, Home Buyer in California, San Bern...

Cancellation of purchase agreement.

Asked by Lu, California, San Bernardino, CA Fri Aug 17, 2012

My offer on a house was accepted, escrow was opened. On the next day, I informed my agent, who is a dual agent in this case, that I wanted to cancel the purchase contract after I reviewed the reports and disclosures, and asked the agent to send me the cancellation form to sign. It has been two days, my agent still has not given me the cancellation form. Can anyone offer me any advice of what I can do in this case?

Write a cancellation letter and deliver it by fax, email, sms, and certified mail. Send one to your agent / broker and one to the escrow stipulating the return of your deposit.

No problem.

Contact your agent's broker and do it before your contingency period expires.
Good luck

Put it in writing! Email or letter and deliver. If you can't get in touch with Agent via phone, find out who her Broker is and contact him/her. (Foe example is she with Coldwell Banker, Remax, etc.)
Typically you have 17 days to cancel unless your offer said different.
