Can a broker sign an Exclusive Buyer Representation Agreement with a buyer when that broker is representing the seller as a dual agent?

Asked by Trulia Fort Lauderdale, Fort Lauderdale, FL Thu Jan 24, 2013

Isn't this a conflict of interest?

When a broker has both the listing on a property and the buyers/s, in FL, he/she can either choose No Representation status OR Transaction broker

Dual agency is NOT allowed on the state of Florida. You can choose from either of the three brokerage relationships transaction broker, single agency or no brokerage relationship.

As long as the seller agrees, preferably in writing, and the agent fully discloses to the seller exactly what that will mean to them, there should not be an issue.

Statutes very from state to state also, verification will be required by the Governing body of Florida.
