Can I obtain a copy of the CC&R for a townhouse I'm interested in buying before making an offer. The

seller's agent says we can get a copy only when the property goes into escrow. Is the CC&R a public document that can be requested from the city? Thanks.

Hello Gina,

Sometimes it's quite a process to get CC&Rs from a seller/agent because if they are not online most HOA management companies won't give them to you unless you are in escrow. Ask your agent to request them from the listing agent. Let them know that you are truly interested in the property (if you are) and see if they can give you a copy to borrow. If you have specific questions regarding the property you might want to see if you can ask those specific questions as the typical CC&Rs "kill a lot of trees" and are rather in depth. Finally as if they might have the original copy that the seller got when they purchased. They may be slightly outdated BUT they might be able to answer some of your questions if they aren't available online.

Thu Dec 13, 2012 can get a copy of both CC&R of a town home from the HOA. You can find out the HOA contact info. from your realtor or ask one of the residence in the same complex. It is a public record but you got to pay a FEE to the HOA for requesting these documentations.

CC&Rs are recorded documents that are available to you prior to opening escrow. Many HOAs have websites that include access to the CC&Rs via an online system. You should google the HOA for the townhome that you are thinking about making an offer. Failing that, you could ask your agent to have his/her title rep get a copy for you - you may have to pay for that service. Once you open escrow, you will also be provided with a certified copy of the CC&Rs along with the HOA financials and the minutes from the meetings for the past 12 months, so unless you have some specific concerns, you may want to wait.
