Can I get a loan approval through a different lender, although I am 2 weeks passed my escrow closed date?

I am currently in Escrow, and 2 weeks past what was supposed to be a 30 day escrow, and cannot close my loan. Can I try to get a loan approval through another lender, without risking losing my deposit? If so, what would happen if I cannot get another lender to approve me. What would I need to do, and what would happen to all the money I have invested? (Home inspection, appraisal, deposit).

I haven’t removed any of my contingencies (including the home loan), and as far as the seller he is giving me as much time as I need to get my loan closed, since he doesn't want to put the house back on the market.

You should get an extensipoon in writing to get a mortgage and then have your buyer agent guide you with a bank or mortgage company that can do it. DOnt rely on verbal extensions, get it in writing

If the sellers are giving you the time you most definitely try to have a different lender get your loan finished. Put in a extension of time, and hold on to your contingencies. Communicate with everyone on the loan process, and where you are at with the loan. Generally as long as everyone knows what is happening, and you look to be making a diligent effort to get the loan the seller may continue to give you the time. Do not release the loan contingency until you have full loan approval.

It is not just your contingencies, but other terms of RPA and ADMs to it. Try negotiating with the seller about extension of the escrow. But if you do want that property and your present lender is not able to close your loan, there is no sense to wait any longer.

In regards to your question. My little advice is that you go to a bank in your area to request for the loan, and that is if you have a collateral, but if you want a loan from those that give out unsecured loan without a collateral i know of a loan firm that gives out unsecured loans, though he is the only one i have tried for now so i don't really know if their interest rate is the lowest. Few months ago when i had a bad credit, a friend of mine introduced me to them, inspite of my bad credit they were able to lend me a loan of $20,000 of which i used to revive my business, I think you too can do the same as well. Get a contingency extending your loan approval date and escrow closing date. Signed by both seller and buyer. Do not know why original loan was not approved. Did lender flat out decline loan or were there contingencies that buyer could not satisfy? See if you can satisfy contingencies from orginal lender. At same time I would apply with another lender. I would Pre-approve with 2nd lender first to know if I will be approved. None of buyer's contingencies have been removed but not extended.

The key in this situation is the seller. As long as they cooperate (agreeing to wait and sign an extension), you can and should try everything to secure another loan. If a loan cannot be secured, although your deposit should come back (not removing contingencies), your investigation and processing expenses (appraisal, inspection) are not reimbursed.

Dear Ms. Lopez,

It has been my experience that loans are taking longer then normal to fund. Underwriting is much stricter now and I have noticed that, a loan simply will not fund that quickly(25-30 days). If the seller is willing to work with you, they might already be aware of the situation and willing to grant you the extension you need.
Unless there is some reason to think you will not be able to get your loan, My opinion us to just give the bank time to fund it, rather then get another loan at this late time of the transaction.

Dear Miss. Lopez. There is no cook recipe for a transaction, but you can take in consideration several factors, like the seller type and his preferences, as long as I can understand if you have no extension approved by the seller, you have to get an extension for another 45 days to close if you want to switch lender and continue with an escrow open.
The lender type; If your lender is direct lender your probabilities to close are high, if you are working with a lender at your bank, usually takes more time to approve due they work only office hours and their appraisals often are out of area.
You have to work really close with your agent and contemplate different options, a) get out of the deal without remove the contingencies and try to get your deposit back and say bye to your money invested, except your deposit. b) If the seller is willing to give you as much time as you want, and you like the property, what I will do is get the extension I need, talk seriously to the lender and submit the application to another lender and see which one can close, but tell them you are working with both lenders and you will take the one close faster. c) Talk to the seller and find out if he is willing to carry part of the loan in a second and get his terms.
Those options are based on what I understand, but for sure, there are more to explore. Take your time to talk to your agent and dig for more options. Alvaro Lozano CA DRE 01360485
