You can't back out, after closing, because you are now the legal owner of the property and responsible for any expenses and repairs.

If you can prove that the sellers hid this defect, you might be able to sue them... but proving that they knew about this potential flooding can be very difficult. Did your inspector mention any evidence of prior flooding? ... more

Do you mean a great seller's market, buyer's market, balanced market, etc.? Add some more details and hopefully more people will be able to help answer your question.

Thanks!

The market is hot for sellers at present here.
Contact your area Realtor and he will give you the number of days a house sits on the market in your area.

Good Luck.

Thank you Ron.

Technically we can't afford the home. We have been struggling to stay afloat for while now and when we found out about the foundation problems earlier this year, it just made our hearts sink.

After reading articles online and seeing that MO is a recorse state, we starting thinking about filing chapter 7 bankruptcy. Guess I will go and see an attorney about this.

It's hard to say without more information. Most houses in that area (assuming they are in good shape) are worth $55 to $75k.

Ora,

It would be advisable to deal with specifics as much as possible.

In doing so, it may be beneficial to speak with several lenders and provide them with exact information. They will be able to best advise you on possible programs and your availability.

Best wishes,

Here you go, all of the Two bedroom / One bath homes that have sold in Grandview from January 1, 2008 through October 17, 2009. Not nearly as many as I thought.

There are many other things to consider, basement, age, neighborhood etc. I hopw this helps. The link will show you all the 2/1's in Grandview sold since 1/1/08.

http://portal.heartlandmls.com/de.asp?k=49468XEEBV&p=DE-1612992-722

I had to post this twice as the fist link did not include all the listings. Hope it helps.

Vicky Chrisner answered:
You should consult a qualified tax advisor, but my guess is that if your past tax returns clearly show that you have held a rental property and not a principal residence, then you likely can claim the credit. Again - do not make decisions based on any answers you get here, this is a tax question and most responders will be real estate agents, not tax professionals. Also, since this is a new law and grey areas may remain undefined, we really should not be giving you more than our best guess. ... more

Derek,

When were you called out of town? I see where this property was listed late last year but, it hasn't been on the market for a few months. Did the listing agent ever contact you or any or the tenants when the property was on the market? The cleaning crew may have been contracted directly through the property owner.
