We have water in our basement every time it rains. There was no mention on the disclosure by the past owner.

Can we take the owner to court on this? The house went into foreclosure after the papers were signed. We have contacted the previous owner's real estate agent who was no help at all. Is arbitration an alternative?

You might want to check the drain tile around your house, usually at a corner, its black. Check and make sure it is cleaned out, alot of times it is filled in with mud or dirt. Most of the time when water gets into your basement atfer rain that is usually the cause. If it is plugged up water backs up because it has no where to go ,therefore it seeps along the footings draining into your basement instead of out the pipe. Check your drain tile first. Simple fix, hope this helps.

Did you have the home inspected? Did you examine the basement prior to making the offer? Unfortunately unless there was documentable evidence that the listing agent withheld information or attempted to actively decieve you there probably isn't much there. Given the amount of snow this winter and rain this spring you may also have a situation where the ground around the foundation has settled or been eroded enough to create a new situation or make a marginal old one worse. With the foreclosure added to the mix you've got an uphill battle. If they didn't have the assets to keep the home, I doubt you'll have much luck getting anything monetarily. What does your agent say?
