What are my options for a 2nd mortgage I didn't agree to on my house?

My now ex-fiance and I purchased a house together. While together, he took out a second mortgage on the house and I did sign it for a siding upgrade/home repairs. However, in this second mortgage, he also consolidated a large amount of his personal credit cards into this loan that I was not aware of. We ended our relationship, and he agreed to it being his responsibility to continue to pay on that second mortgage since it was mostly his credit card debt that was consolidated into it, and I had paid off a very large amount out of my own personal income tax rebates of his debt while with him. Now, he has defaulted on this second mortgage, and the company is calling me to collect. He should have the money to pay it, but is not, and I do not have enough to pay the full amount. This creditor has refused a partial payment on this loan that I did offer to pay them. What can I do? P.S--we have a child together who resides mainly in this residence with me. Thanks.

I am so sorry that you are in this situation with your exfiancee. But, to be blunt, that is not the mortgaage company's problem.
What you sign is what they are counting on-- and rightly so. You might contact an attorney to secure payment from your ex, but the Mortgage company has (it sounds like) a valid claim on you and on the house.

It is SOOOOOO Important to understand that what someone says at a point in time is NOT the same as what they (or you!) sign your name to on a legal document.
