I rent a room, month to month lease, with no formal lease or paperwork in a house that was sold in auction via foreclosure. What rights do we have?

Since you have no written contract you can not be considered a tenant. Did u have mail sent to the home? If so u can be considered a resident. The new owner will ask you to vacate the property. They more than likely will give u a deadline to be out by. To avoid them having use the eviction process against you, you should vacate the home by the the date they ask you to be out. A foreclosure actually wipes out any agreements. it could be argued that you and the previous owner had an agreement but since it is not in writing, you are probably in a very bad postion and will be portrayed as a squatter.

I can't give you advise except to say that you should start looking for a new place to live.

Dear Ms. Payne,

Unfortunately without a written contract it's difficult to know exactly what your rights are. Since we are not lawyers on this site, we can only guess that you will have to start looking for another place to lease right away.

Basically, you have no rights. Unless this property is two or more units, single family residences in L.A. City are not under rent control. Therefore, you could get an eviction notice from new owner without any relocation assistance. I suggest to work it out with the bank representative to see if they can allow an extension.
