I am currently renting a home that is going to be sold at a sheriff sale june 11th.

Asked by Melissa, Livonia, MI Sat May 17, 2008

My lease is for 1 year from 2/1/08-2/1/09. The property managment company also listed the house for sale on March 28th of this year, but did not put a sign up. The managment company will not return my calls. but had no problem accepting my rent a week prior to me finding this out, coming home to a note on my door informing me of the date of the sheriff sale. I dont know what to do. what are my legal rights? Should I continue to pay the managment company?

Hi, Melissa!

This has become an all to common problem. Yes, you do need to seek legal counsel on this one. There are some creative strategies I have heard to handling situations like this.

I am also in Livonia, so if you need any assistance with another lease or a purchase, please do contact me. We now offer Tenant coverage through our title company which gets filed as a lien ... unique and necesary in today's climate!

Best of luck to you if I don't hear from you...

Melissa, Only a lawyer will be able to advise you of your legal rights. This website may provide some information http://www.legislature.mi.gov/documents/publications/tenantl… about your rights and responsibilities as a renter.

There should also be an orange sticker that was placed on the door with a contact number. I suggest calling and letting them know you have a lease and the home is occupied.

There is a 180 day redemption period for most properties after the sheriff auction. I suggest making sure whoever purchases the home is informed by certified mail you have a lease. Your lawyer would be able to do this.

You can search for leases available in Livonia and surrounding cities on this website. http://moveinmichigan.com simply enter the 1 or 2 (thousand) as the upper price limit.
