Home loan issue

Asked by Wawsjg, Jackson, TN Thu Mar 21, 2013

Awhile back ago me and my ex husband bought a home and after a few years it got foreclosed. Now don't my question is I didn't cosigned for the home loan its only his name but I am on the title. Is it true that even tho I never cosigned they can still sue me? Because I had a name on the title.

They can foreclose upon the collateral, which in this case is the property, so your name is probably on the deed and they will have to transfer the deed back from you to the bank after the sheriffs sale.

If you did not put your name on the loan and did not sign the mortgage note, then there should be no way a lender could come after you personally. The home has already been taken back by the lender according to your post. This is as far of a recourse as they would be allowed to go.
