I don't believe Mr. May is familiar with Arizona statutes. In Arizona, it is an act of fraud to list a home for lease or sale without broker approval.

What is a listing? One easy answer is to answer a question: was the home listed on the Multiple Listing Service? If the answer is yes - regardless of commission/referral fee or none offered - the home is "listed."

Signed documentation allowing the agent to list on MLS requires that the brokerage document the transaction by placing the home in a lease folder according to Arizona state law.

If it was listed on MLS and the agent has NOT placed the fully signed listing paperwork and the fully signed lease along with any commission or lack thereof in the brokerage's lease folder, it is fraud and a felony in the state of Arizona. The likelihood of an under the table commission cutting the brokerage out of the commission is strong.

The agent is unscruplous.

Posting your question here isn't effective. To begin with Trulia isn't in real estate, they are in advertising. Secondly they don't read these questions, these are for other Realtors, Lenders, Property mangers to answer.

Your question should be directed directly to your Realtor who should be handling this directly for you. If their not or their telling you they can't what they're really telling you is they don't really know what their doing. They have control over your listing but it doesn't sound as if their exercising it based on your comments.

It's not as complicated as it may sound and if you're all working with experienced Realtors they should be able to easily handle this for you. The potential buyer of your home seems unduly anxious, but some folks are simply wired that way. If you're not working with experienced Realtors, you can always simply have an attorney handle the lease back arrangement. You do not necessarily have to do this with the Seller of the home you're buying but you could. There is a contract in place; so unless you have some reason to believe the sellers would suddenly change their minds and try to breach the contract there's no compelling reason to do this with them. Alternately you could simply refuse to do what the potential buyer of your home wants and they'll either live with it or you'll find another buyer. ... more
