First it depends what State you might be referring to since the laws are different from State to State. In Florida the agent must work under a broker who is responsible to the licensing authority. This is to allow an agent to operate within the laws of the State. Normally a broker owns or manages a real estate office.

A broker holds the license to run the business and the agent holds the sales license to work for the broker.
