If the home owner knows that the home has Chinese drywall, they have to disclose it.
If you find a home you want to purchase, you would sign a contract with right to inspect. You have 15 days to get the property inspected. If the home inspector finds something suspicious, he/she will recommend a chinese drywall inspection be done. You, as the buyer, would have to pay for the home inspection as well as the chinese drywall inspection. You can also find an inspector that does both. If the inspector suspects it might have chinese drywall then he/she can go ahead and inspect for that as well. If chinese drywall is found and you do not want to pay to have it repaired, you have the right to cancel your purchase offer.
