We have also asked our current broker for a termination of our contract, two months prior to the listing end date. They provided a form that simply states "Listing to be Withdrawn 10/31/13", all other conditions of te contract are still in effect. I do understand Sectio 7.3.3 of our contract. We have NEVER been provided the names of any potential buyers, nor have we had any written offers on this property. So, I believe in our case, Section 7.3.3 is moot (note: the hold over period is 180 days, not 60 on our contract). What we want to do is immediately list it as "For Sale By Owner." I believe we can go ahead and do that, as of November 1st.

Any professional advice on my interpretation of our situation?

If you are speaking of Berkeley, which includes zip codes 80211 and 80212, then you are primarily talking about comparing vintage housing. Price per square foot is never used for comparison with vintage housing, as there are too many variables that affect it, particularly in neighborhoods with such a wide variety of homes sizes. The average PSF for a 1800 sqft 2-story Victorian will be vastly lower than that of a 850 sqft Bungalow, and in nearly every Northwest Denver neighborhood, they can exist right next to eachother. PSF does not take into account a basement, basement finish, quality of above grade finish, system updates, a garage, lot size... you get the picture. You can see why Brokers who specialize in vintage housing rely on comparable sales only, not PSF, to determine home values. Appraisers don't use PSF to determine values of vintage homes either.

If you would like a neighborhood specialist to assess the value your home, I would be a good choice. No one does more resale business in 80211 or 80212 than I do, and I would be happy to come by.

Two things. First of all, Trulia is not the standard for pricing in your neighborhood, your Realtor is. Second of all, almost every decent property priced correctly in Denver and under $200,000 is running into multiple offers and 'bidding wars'. There are some agents and most banks that list properties right at market value or a little under for the express purpose of generating 'bidding wars'. This is not a negative for you, but a positive. Go with the highest bidder. You can get a second opinion from another Realtor to make sure you are getting a good price for your home. I would not automatically assume that your agent is being unethical in this transaction. You can also speak to the Managing Broker of your agent's company to calm your fears. If you are not being represented correctly and to your best interest and all of the right disclosures in place, there are ways to back out of the contract. Let us know what happens.

Hopefully she has worked through this period of chain tragic events. Unless you are fully versed on real estate contract law, hire a good realtor. Do you know your rights within a purchase and sale contract? More importantly, do you know buyer's rights? The buyer has considerably more protections that the seller. How will you address inspection issues? What if your home doesn't appraise?

Most importantly, "REAL" qualfiied buyers in the cars of realtors. I know it looks good on paper to attempt to sell on your own, but here's the reality ... if it were that easy, there would NO realtors. FSBO is like going to court without an atttorney ... you can do it, but the result won't be in your favor.

Don't fall in love with a number!! The truth is nobody gets paid, including you, until your home sells AND closes. It looks easy -- it isn't.

Kind of a nebulous question. The contract language will determine how title is held. Either by Joint Tenants (Both own equally with right of survivorship) or Tenants in Common (Each one owns half and each one's heirs would inherit if one passed away). If it is purchased by an individual it is called Severalty. Does this answer your question?

blue, and now many have listed their phone numbers on the do not call list. Waste of time.
There are so many better ways of connecting with potential buyers and sellers.

I live in this zip code and have been watching the trends. This neighborhood is selling fast! Over the last month, in Skyland alone, 16 houses have gone under contract and most don't stay on the market longer than a few weeks.
It is a great time to sell without having to worry about your home being on the market long. Also, low inventory along with the time of the year, you will only be working with serious buyers and not so many "lookie-lou's"

The title companies we use are well aware of these crimes and it's even noted if you are placed on hold during a call in to them, during the hold recordings. If there is something specific you are needing as far as coverage, I would love to set an appointment with one of my title company sales reps.

I have run into this problem often. One in the couple has good credit and the other bad. Depending on how bad the one credit is, they may not be able to be on the loan. If the one with good credit can qualify for what you want you can go with that and then do a 'Quit Claim' after closing to add the other party on to the deed. This is a good question for a lender who can tell you the specifics of your particular situation. You also need to get legal advice as to what happens if for some reason you don't stay together so you know what happens with this asset. If you need a good lender to review your options or a Realtor to help you through the process, let me know. Best of success.

You would be well advised in creating a Value Package that will appeal to real estate professionals.

You need a "thing" in which to distinguish your service.
I recently saw a "HANES" ad on TV. The distinguished feature was...NO TAG! Seems as remote to the product as a value statement can be! Yet, there they are....chatting about "NO TAGS TO IRRITATE." Just like Restless Leg Syndrome, no one know they are afflicted with such threatening problems.

I just 20 seconds I thought of four biggies in which to distinguish your service and not compete on price alone.
1. Vaulting to secure Film roll
2. Syndicating to other video libraries
3. Meet me
4. Hybrid

Now that you have a product of distinction...(you could easily offer all four, but you need only one, allow room for additional features) you need to position it to solve a problem or produce an outcome that either the agent wants or the home buyer demands. You know, demand like, "Get rid of the tag!"

For instance, Hybrid increases sickness. If you have ever watch folks searching for a home and watching those tours....THE LIGHT WILL COME ON!!! Agents will want sticky tours not productions that test endurance.

Another note: If you get a chance to tour a neighbor's home that is on the market, use that opportunity. If you already know that others bought the granite counters and other upgrades, then it won't be necessary to bother. You may already know you haven't kept up with the Jones.

Kitchens more than any other single room sell homes. The decision to buy often is made by the person who spends the most time in the kitchen. And, these days homeowners gather in the kitchen more often than any other room. If you're home is the bland one on the block, then you should address at least one item. Tip: Upgraded counters do wonders for a kitchen. With some new paint and maybe a new stove, you will outshine a good deal of the competition out there - even if they bought upgrades when they acquired their home.

You won't necessarily increase the value, but you may get multiple offers - which is even better.
