You really can't do a rent-to-buy (technically, a lease-option) in Texas. It's legal in the other 49 states, but the restrictions in Texas are such that it really doesn't/can't work.

There is an alternate structure involving Illinois-style land trusts that will work. See http://www.landtrust.net or e-mail me.

I wrote a blog on how to find lease-options. It's at http://bit.ly/findaleaseoption Again, though, lease-options won't work properly in Texas. But you can use this technique to find willing sellers, and then you use a land trust instead.

Hope that helps.

it is possible in Texas with work arounds, but not advised. Owner financing is your best bet in my opinion.

The reason most people seek this type of transaction is because they are not eligible from a mortgage from a traditional lender. Any work around to side step the mortgage underwriting guidelines shifts the risk from the lender to your side of the ledger, greatly increasing the odds of disaster. The guidelines are actually fairly liberal despite what most people believe. I have linked below some info on rent to own, but there are several other topics on my blog that may protect you. I hope my observations keep you away from harm, good luck.
