I don't believe Mr. May is familiar with Arizona statutes. In Arizona, it is an act of fraud to list a home for lease or sale without broker approval.

What is a listing? One easy answer is to answer a question: was the home listed on the Multiple Listing Service? If the answer is yes - regardless of commission/referral fee or none offered - the home is "listed."

Signed documentation allowing the agent to list on MLS requires that the brokerage document the transaction by placing the home in a lease folder according to Arizona state law.

If it was listed on MLS and the agent has NOT placed the fully signed listing paperwork and the fully signed lease along with any commission or lack thereof in the brokerage's lease folder, it is fraud and a felony in the state of Arizona. The likelihood of an under the table commission cutting the brokerage out of the commission is strong.

The agent is unscruplous.

That does sound like a great way to make a buyer fall in love with your house, but know of no specific provision waiving the rental regulations due to the property being for sale. However, if I were in your shoes, I would contact the governmental authority for that area to verify.

Barbara's proposal is interesting....but I think you would need to be careful not to veer into leasing. I think the bottom line is that if your guests annoy the neighbors in any way, you run the risk of them complaining. Fines are steep.
