Fannie Mae is typically for REO homes; you need to find out what your state real estate laws are when it comes to liens. In Ohio the buyer agent should always inform the buyer that they should contact a title company to ensure there is a clear title. Typically if the bank takes the house back it should clear the liens however again it depends on what kind of offer you signed. Typically, in purchase contracts you can cancel your offer based on cloudy title but if you signed docs by Fannie Mae and they usually give you a clear title but it's a limited clear title; meaning, they only cover the time that they took possession of the home to sale. ... more
