Hi, can you tell my friend how to best get a copy of her HUD-1 statement? She did a short sale on her home after her divorce and is now purchasing a new home. The loaning bank needs a copy of her HUD-1 which has been in a box in storage somewhere for the past few years. She called the agent that worked on the sale of the home and he seems unconcerned and non-committal about looking for the Contract for Sale & Purchase, so she wants to start with the title company but does not know who they were, Any guidance you can provide will be greatly appreciated. When purchasing a home, taxes and all other liens will be paid through escrow by the proceeds. If the proceeds are insufficient, which is determined very early in the transaction via the title report, the difference becomes a point of negotiations meaning those lien holders will need to agree to accept less and release the lien. If they do not, the transaction is cancelled and the buyer is under no further obligation.

Keep in mind, when you buy a property, the transaction may trigger a reassessment of the property causing the tax bases to either increase or decrease based on the actual sales price.

If you are interested in acquiring a home in this area, it is wise to contact a local realtor. If you are buying with cash, be prepared to provide "proof of funds" if not you will want to get a pre-approved loan with a lender who can guarantee an on-time closing and work closely with your realtor.

Welcome to the world of Realty Trac; the property (if it is 6921 Birchwood Circle) does not come up as having an opening bid of $22,500 but shows an opening bid on Foreclosure Radar of $336,804. The Auction date is set at Feb 11 and the miimum bid may be modified at anytime prior to the sale date. Just know if you are scrollilng through the Realty Trac properties that you will, unfortunately, find a great deal of misinformation.
If you are planning to engage in the potential purchase "at court house steps" know that it is incumbant on you to do thorough research not only on the property, but the potential liablities that may survive the foreclosure sale and become your responsibility.

This property was a little confusing to figure out from our online search records. In Foreclosureradar, a separate foreclosure search tool available by subscription, there shows no recent foreclosure activity. The tax records show a lis pendis against that property as well as a notice of trustee sale. All of that indicates the suspicion of a lawsuit to protest the foreclosure proceeding.

You can work with an experienced real estate person (direct investor, or realtor) to try methods to contact the current owner but my suspicion is he's relying on an attorney to use a loophole to save his rights to the property. That doesn't hint to me that he's someone who wants to sell.

I'm not sure it's really in a position where it was sold as you believe. The most expeditious method to find out for sure, might be to send a letter to the owner of record, or approach anyone who lives there. But I'd be careful in how you approach them- with sensitivity and understanding for their circumstances.
