Thanks for the post. I actually scan all of the Trulia rentals every couple of days or so, and flag as many of the scam listings as I can. I do miss a few, but most of them I do tag before it's been posted for too long.

Most importantly, never send money to anyone who cannot show you a home themselves, and does not have KEYS to get into the property. Never wire money to another party or show them your "wiring information" or give a check, even a voided one, to another person for a rental home. These are all ways in which you identity can be stolen.

Finally, you can always "cross check" any suspicious rentals with the actual MLS listings here in Santa Clara County, by looking up the home and address via the public portal of the very same multiple listing service that we (Realtors) use. Just go to www.mlslistings.com and type in the address. If the home is for sale, as is the case most of the time, it will show up as a listing.

It appears that the property may have been first listed on hotpads by a company calling itself "Go Section8". The company's web site appears to have a private/hidden domain name registration. The pictures look bad even by cell phone picture standards. There are too many signs that this listing may not be approved by the property owner.

The picture shown at that page was taken when there were few leaves on the trees. The advertised rent is too low.

The property might be available from dwm properties for $2,350 per month which has the same old picture posted on their web site along with a note saying available late August. However as Grace said the property appears to be owned by SRI Credit Union

However The State Of California does not have any record of a Real Estate License for anyone named Terry Williamson and there is no Real Estate license number listed in the advertising.

California State law requires that anyone representing the owner of Real Estate must have a valid, active, real estate license and the real estate license number must be included in the advertising.

Also, the advertised rent for this property is far below the fair market rent for a single family home of this type, in this location.

There have been many scams in advertisements of homes for rent where the person advertising the home for rent does not have a valid, active real estate license and has no written agreement with the owner of the home to actually rent the home.

The scammers collect a security deposit and prepaid rent from you, and then disappear with your money.

Another variation on this scheme is that the scammers collect enough information on you through the rental application that they are now able to steal your identity, and empty your bank account.

I suspect that this advertisement is a scam that is designed to steal your money, or your identity, or both.

If you feel that you must deal with this person, I recommend that you demand their real estate license number and then verify with the State of California Department of Real Estate that this person actually has an active, valid real estate license.

Also I recommend that you ask to see a copy of the listing agreement to verify that the owner of the house has a written agreement with this person to rent the house.

I suspect that this person listed as the contact person in this advertisement not only does not have an active real estate license, but also that this person does not even have a written agreement with the owner of this property to even rent the house.

There is a hotpads.com posting listing it for rent by Sequoia Property Mgmt. The website for the property mgmt company has very little information even though it was registered in 2000.

The San Jose Better Business Bureau hasn't given a rating for the property mgmt company.

In any case, when there is a litigation, no one should relay any info to outside parties, let alone sharing it on a public forum. If you call the HOA, they won't disclose any info either. If you are a buyer as it says you are in your Trulia.com profile, you are going about the buying process in the wrong way. Let's be honest. The link that you provided was to a property that was clearly labeled "Sold" but you asked if it is available.

If you are serious about buying you should align yourself with an experienced Realtor who can guide you through the buying process. Your Realtor will show you properties that really are available, help you to evaluate the properties, help you to arrive at a realistic price, write an offer for you, help you to negotiate an agreement, help you to get approved for a loan, and help you to negotiate the escrow process. Hi Judy, now that the link works, I confirmed this home is not for sale but involved in foreclosure. If the property becomes bank owned it will be several months before it makes it back on the open market. It will also be priced according to the current market value of what others have sold for in the same complex.
