It may be a question for your HOA manager or a lawyer. You would have to review your deed and HOA rules to see what is or is not deeded. If it is an emergency stairway, it should not be used for daily use. Usualy a porch is limited common use and not fully deeded, which is why a lawyer should see how your deed is written and what you can do about it if it is. ... more
