I bought my condo 10 years ago. With the knowledge that the under ground parking garage space was "sold". I did not know at the time that the spaces were not deeded and there was one assigned space to each unit. (48 units, 48 spaces). I have tried to fight this with at least 3 different attorneys and they seem to be baffled and say they cannot figure it out. The President of the board told me the space wass sold years ago to one of the condo owners. I approached the owners of the space and they told me it "came with their unit" years ago. I believe they are the owners, the story goes, gave my previous condo owner $5000 for the space because she did not drive it anymore. Again, these are not deeded spaces, so they cannot be sold. In the meantime, this condo owner has sold the unit with the two spaces, however, his wife is still the mortgage holder. They produced a title that shows the new tenants name as the owner, however, they financed it for this person. There are no rentals allowed, so I believe they did this to show this woman was the new owner so now she has my additional space. I am at a complete loss. Recently the President told me she is trying to wait until this owner sells or she will talk to the building attorney to see if it can be returned to my unit....I am not holding my breath because I've called her twice in last two weeks and she tells me attorney has been in depositions all week. I am beyond frustrated and feel completely mistreated in this building. Please, if you can offer any help or advice, I'd truly appreciate this. Sincerely, R.
