Good question. As many have already said it's not on the market and may or may not ever come on the market. Just because a property is in pre-foreclosure doesn't mean it will ever be sold at auction.

To the poser of the question, just so you know, this property will likely sell for around $300K +/- at auction (plus buyer auction premiums). It is a very misleading listing. It will not sell for anywhere near $90K.

This home is not on the MLS as for sale. There are lots of homes that end up on national sites because they are on a list of homes that might be foreclosed on, have been foreclosed on, or where sold - but are not on the market now. In short phantom listings.

The link below is everything that is currently on the MLS in Brentwood. Even some of these listings may no longer be available but remain on the MLS as the seller gets signatures and things together.

Check the paperwork (contract) you received from Blue Mountain, and read all the fine print.
If you have something in writing that states that Blue Mountain protects their homes for 1 year, then you may have a case against them.

First, initiate contact with the vendor (att: real estate sales agent/consultant that works for the builder that sold you the property). Or if you were represented by a real estate agent, contact your agent. Then send a demand letter/fax to customer service of Blue Mountain outlining your demand to have your AC fixed and give a time frame (also cc. Management of the company, real estate agent/consultant, etc.). You may also put in your letter a reference to the DRE, so that it carry more weight. If this does not produce any results, you may be able to take it to small claims or mediation.

You might also want to pose this question to a real estate attorney at www.lawguru.com. At this website, you will be able to ask questions to lawyers for free.

Whatever you may do, you should document these incidents, and communicate your request for repairs to your landlord in writing. If the owner has recently replaced the AC, it would seem to me, that it would still be under warranty ? I think, that ca law allows tenants to get emergency repairs done if it is not performed by landlord after 3 days. But you may want to verify this at lawguru and pose the question to an attorney who is knowledgable about ca real estate law. ... more
