The CFPB is probably the best way to force the service to correct the error. Unfortunately this is not something that any other lender is going to be able to help you out with because they cannot make manual changes like this on the HARP program.

Outside of that, you may want to get a real estate attorney to assist you as well. The good news is that rates have come down a bit recently and HARP has been extended beyond this year. So even if it takes awhile to get things rectified you should be OK

It will state the details in the purchase and sale, but yes, as long as you submitted your application by the date in the mortgage contingency and received notification of a rejected mortgage commitment on or before the commitment date listed in the commitment, your deposit should be protected. Talk to your attorney and agent.
Hopefully you had a Title 5 contingency in the offer and PS. This way if the sellers have not installed and had it inspected by the date specified in that contingency you should have legal leverage ... If this is the case it's time your attorney stepped in to alert them / their attorney they are in breach of contract.

When a seller signs a contract to sell their house, they have to do just that, sell it. And, if it says they have to replace the septic tank before they close, they have to. As far as closing goes, what is the closing date in your contract? Each state has different customs as far as how far past that date you can go before you are truly in violation. The contract never specifies what the seller plans to do after closing, other than vacate the premises by a certain date, if they are not out by the closing date. Again, sometimes it is customary to give the seller 5 days to move out. What does your agent say? Are you represented by a lawyer? ... more

General rule you submitted a sales offer however not heard back from bank . You can submit as many offers as you want, many agents wont' do this for time vested however, you may never have a response back from bank on foreclosure. IF seller does not like offer most won't reply.

I recommend push on leave other contract open as a back up submit an offer on home you want pursue.

I've specialized in REOs with this changing market and various loose ends need to be addressed with each asset. Hang in there if it is the proeprty you desire.

Virtually all foreclosures deeds are not recorded immediately after foreclosure. They usually wait until the bank to find a buyer before someoen realizes it, then they have to tracj down the deed or even prepare it, get it signed and recorded. then they can prepare the new deed to you, as teh new buyer. it usually takes a couple of weeks but with a couple of banks it has been a couple of months, stay on them daily. have your agent find out which attorney is responsible and contact them direct, again do it daily to move them along. good luck ... more
