Let me ask you this; if you funded a mortgage on a property for someone who eventually stopped making payments and you had to take legal action to evict them, would you turn around and allow another person to move in, who has even less at stake and could potentially cause serious damage to the property? ... more

Yes, Don is correct. What you see in RealtyTrac are not actual listings. They may be someday but these homes are not assigned to a listing broker as of yet and are not available for sale. Once they are in the MLS, which is where they all end up, you can look at the full listing with address information.

We hear of this frequently.
Although I've never heard them say don't pay.
They normally want as much money as you can send them as fast as you can send it to them.

Sorry this happened to you.

Probably the best thing to do now, is pick of the pieces...start moving forward. Save cash and plenty of it for the next down payment.

There are a couple of deadlines that can release you from liability for earnest money. At this point you will really need to look at the third party financing addenda for the number of days to obtain financing. If you are still inside this date and the inspection issue will effect the habitability of the home then you probably need to go there. With out knowing all the details that would be a place to begin.
