Try this link, it should open the form for the Orange County recorder's office. Make sure you read up and do it correctly as I have seen more than one person do it wrong and not get the benefit.

If you already have sold or purchased a new home you may have difficulties. There are time frames you need to meet.

Short answer, no.
Long answer, no.

Call the listing agent's broker and ask him to get involved. If that is not an option then pursue arbitration. No arbitrator is going to award a seller one penny when all contingencies were in place. If you did not sign an arbitration clause in your RPA then you may want a lawyer. You may want one anyway however your agent should be able to facilitate a deposit refund because the seller has absolutely no case.

They can drag their feet for a while just to get under your skin but you can always send an attorney letter and that should loosen them up.
