I'm not the listing agent but I can see that the fact that it is an elder care facility is disclosed on the MLS Listing information to agents, so anybody interested in writing an offer would be aware of this fact before writing. If there is a hospice across the street, this would presumably be stated within the seller disclosures.

A lot of if's in the answer. First off the seller has to accept the offer and agree to your terms. This can sometimes take longer than you might like. Then it depends on how much time you want to take investigating the property. Inspections take time as do Appraisals; and I really think inspections are important. This is a great area to be looking. Spacious homes, views, great schools! Just a tip, most Realtors share access to home buyers via the Multiple Listing Service. This database updates every 15 minutes. If, however, an agent lists a home and has not yet entered it into the MLS, it will not appear. An agent is supposed to have the seller's written permission if they are withholding a listing from the listing from the MLS more than 24 hours. However, be advised that some agents do regularly withhold listings from the MLS (supposedly with owner permission) to do a 'soft launch' of the home to the market. This means they put it on Craigslist, hold weekend open houses and expose it as new to the market and finally put it in the MLS mid-week just prior to broker's open. I'm not saying this is a bad business practice, only that some homes are 'for sale' but not listed in all the listings searches.

I'm not sure you want to purchase on a lease to purchase basis. It's not really worth it for either buyer or seller.
Let's use an example of a home with a current market value of $400,000.
The SELLER will want a substantial deposit, probably 10%, to agree to a $400,000 sale a year from today, and to credit the buyer half of the $1500/month rent.
If the value goes down 10% in that year, does the buyer want to go ahead with the purchase of what's now a $360,000 home for which he's paying $400,000?
If the value goes up 10% in that year, was it good for the seller to sell a now $440,000 home for $400,000?
That's a simplistic example, but the principle holds.
Personally I would not counsel either my seller or buyer to execute a lease to purchase transaction

Hi Terri, ask your Agent to contact the Listing Agent of your transaction to request removal. Trulia allows Agents to manually upload listings when a data-share agreement has not been established with the local Realtor's MLS system (this listing would not show if such an agreement were in place).

As a side note, sometimes it's best to "think outside the box" a little when it comes to “pre-foreclosure” situations, such as in this case. Depending on how serious a buyer is about a property, there really is no need to wait until a potential foreclosure takes place before communicating interest to the owner. Depending on the situation, both buyer and seller can be well served by such an effort.
