That's an interesting one..... buyer to do the survey and deliver to the seller?
Consult an attorney, but what are the damages to the seller if the buyer doesn't deliver?
Was the survey done and just not delivered or did something else hinge on delivery of the survey, like you're building a building for them, but only if they pay for the survey?

If any party has failed to perform according to the contract the contact maybe voidable. Depending on the language of the contract. However, you should consult an attorney in the event of a contract dispute. I would suggest you consult an attorney.
