I agree with Richard completely. I have yet to see a house that was cheap enough or special enough to justify the risk and aggravation involved with buying a foreclosure or short sale. There are plenty of dumpy homes that you can buy directly from the seller, not the bank. I suggest you buy one of those instead.

Yes the realtor was correct about needed a pre approval to write an offer but if you have one and they won't write the offer . why not? Because you didn't use their lender? Then get another realtor to work with. Tell that agent why you are working with another agent to write your offer before they find out in the middle of the escrow and cause problems for you. The agent should have communicated more with you on why your prequal will not work so your not asking here. We need more information from you. ... more

In my opinion there is no benefit to the buyer by using the seller's agent. It is unwise to make long term decisions based on a few thousand dollars, especially when making decisions involving hundreds of thousands of dollars.

Ouch! What a mess. Before anyone uses a new realtor after that many years of service there should be a talk with them first. Maybe your old realtor wasn't giving you the proper advise in the offers written, Maybe you weren't listening to her advise. Why did your wife choose to work with another realtor? If there is tension there between them maybe it was a good move. Clearly you were feeling guilty of using another realtor. We all need closure on both sides. Nobody wants to be fired, just as most people don't want to do the firing. But both of you will feel better after it is done.

You also can not have the property shown to you by 1 agent and have a different agent write the offer, You are stuck dealing with that agent on that property.

buying a short sale can be stressful.

There are a lot of things to consider. Who is the lender your dealing with?
what was the offer you submitted?
what is the current market value of the home?
You want to make sure that your working with agents that know what they are doing.

some agents will simply put a sign on the home and let it go.

You want to work with an agent who can negotiate with the lender and get involved. If the home needs work you want to have an agent or a negotiator who can prove that to the servicer.

One thing to keep in mind, depending on the lender some home owners will list their home for short sale but also try and do a loan mod with No Intention of ever Selling!!! this is very important to know..

I took buyers into a home last year when the home owner happened to be there. they let it slip that they were also trying to keep the home. that mean to me there was not way they would submit our offer. the would try and show the lender they were not getting offers.

All toxic releases are identified on this list. You can search their database here for toxic releases in any given city or region:

If this is what you are referring to, then the two toxic releases identified were actually in the Los Angeles area.

I have access to a number of recent Natural Hazard Reports from varying companies for the Pleasanton area and none of them show toxic releases within a mile of the Carlton Oaks neighborhood. I’d be interested in knowing exactly where these releases were that you are describing.

This question is from November, but it is a question I get a lot. Ruby Hills is a very desirable gated community in Pleasanton- having said this, upon closer inspection or a quick drive through the community you will see a lot of homes for sale- many are bank owned homes or short sales due to the recent real estate crisis. Ruby Hills is a newer community and in the luxury price range which is where this economic crisis has really been reflected. As a community, Ruby Hills is a wonderful place to raise a family but at the moment it is in a state of flux. However, this could be a real opportunity for an investor or homeowner to capitalize on, with a large inventory of fantastic homes, you might find your perfect home at a price that is below what it cost to build it just a few years ago. Most homes are fully appointed inside and out and ready to move right in.

If you are interested in looking at distressed properties in Ruby Hills or the surrounding area, I can send you a list of homes in your targeted price range.

It is important to know that the appraisal does not necessarily reflect the true value of the home...

My husband is a Loan Officer very recently doing a loan for clients in the area. His appraisal came in $100,000 less than a competative appraisal. Owner did two applications at once.

The appraisal is only as good as the appraiser.

Make your decision on how much you like the home. $15,000 is a small amount.

Can you easily afford the payment at current price? Reducing it by $15,000 will not affect your payment by much... Also your down payment wont be that much higher.
