No you can not. The rules on Short Sales are very clear. The transaction has to be an arms length transaction.

The home can not be sold back to previous owner or a family member of the previous owner.

I am sure some people have come up with "CREATIVE" ways to try and get around the rules, BUT I would not advise it.

A condo in Laguna Woods or outside the gate is a better investment but the price will be much higher for the same square footage, so it may not be an option. The buyer has to have in addition to the sales price, cash reserves of $125,000 plus the purchase price. So the home I just closed on Aragon, the buyer had to have $189,000 plus $125,000 in cash and in addition they got a loan for the $189,000. so as a buyer you have to have substantial cash reserves. The problem is the lack of oversight, plain and simple. The rules are old, $25 fine after 3 letters. It would take an army of people to get out and enforce all of the violations. Residents know that in the end, nothing will happen so they do what they want. Furthermore, nobody on the BOD is willing to implement changes to current policy.

The office is closed all day on Tuesday so the PM/Staff can walk the propert but nobody checks to see if they do. That is big problem.

I recently saw a unit that had a tin can used to keep the slider in place, a front gate missing a doorknob and held closed with moving tape. It goes on and on and has for years.

If you divided the complex you could use Santa Vittoria and Ridge Route as dividing lines. I was envisioning one large HOA with 3 sub-HOA'S.

Pam- There is so many variables that go into an offer. First off is determining fair market value of the property, the competition that may be present for the property, how much you like the property and what you are willing to pay for it. There is no easy answer.

It is not unusual for a bank to give up 5-10% off fair market value in a short sale. With that said is the property already priced below fair market value? is it priced higher than fair market value? It is not unusual for a short sale to be priced aggressively to get multiple offers immediately. If you just unilateraly say ill offer 15% less you may be missing out on good properties you may have paid more for. It is a good idea to work with an agent who has experience in short sales as well as negotiating real estate
