The litigation can only affect the sale if the buyer requested for your unit to be vacant by the close of escrow. In most cases when dealing with a 8 unit complex the buyer is buying the property as an investment. If the new buyer is willing to accept the property with the present tenants then your litigation should not stop the sale.

I hope you find a peaceful resolution with the current owner.
