I know this is a really late answer to this question, but this question is one that gets asked a ton of times!
Buyers who are buying new homes typically have the same amount of questions as buyers who are buying resales- the only difference is that most of the time buyers who are buying new construction, do not have representation.
In a typical transaction, I probably get asked around 500 questions. If you don't have an agent in a New construction purchase, who can you get objective answers from?
In the state of Nevada the lease runs with the property. This means they can not change your rental rate until your lease is up. 45 days before the lease ends they can send you a rate change. As a licensed Agent and a member of the legal community (Not an Attorney) i can tell you that anytime there is a product with a supply and demand or an emotional attachment, there will be people looking to make money either legally or illegally.
You should always CONSULT with a LICENSED Agent as it will bring you legitimacy, value and someone who is willing to work for you for a fare wadge (usually at no cost to the buyer).

Your agent should be explaining all the terms of this counter to you and what if any are the disadvantages to each item.
I had a counter similar with a company that wanted my client to release his Ernest money after 2 days of accepted contract along with other items that were potentially harmful for my client. And to add to this the seller was going to pay an additional fee to my broker if my client signed on the dotted line. Now that would mean I as the agent could gain more of a commission..
However, a reputable agent should always put the clients needs first and foremost..... Of course I recommended my client walk away from a poorly favored contract .
