Your lease should have a section that outlines what happens in early termination. You most likely have to give a minimum of 60 days notice and there may be some sort of financial compensation for the tenant for disturbing their quiet enjoyment of the property.

The bigger question is why you'd have to short sale at all? Based on your question, I'm assuming the rent is not enough to cover your mortgage. Have you fallen behind on payments with the lender and have you received foreclosure notices?

Full disclosure to the tenant might be the best course of action. The renter may be willing to pay more or better yet, they might be interested in purchasing the property. You probably have options you haven't considered. Talk with a Realtor in your area to see what they might suggest.

What area of Anthem is your home located? I post the Anthem Home Sales Stats on my blog monthly.
Today the lender owned homes is the majority in Anthem.

January 2009 the average time for an owner occupied home took 140 days.
February 2009 the average time for an owner occupied home took 122 days.

These average numbers can vary depending on what part of Anthem that you live in.

Anthem, AZ will be featured on HGTV on March 25th...hopefully it will help bring a buyer your way!

I am a real estate agent that lives in the Phoenix side of Anthem...the west side. I would recommend that your agent put "Anthem" as the subdivision and marketing name in the MLS. The zip code for the west side of Anthem is 85087. Some agents from other parts of Phoenix don't realize Anthem has two zip codes 85086 & 85087. It would be important to have Anthem in the description too.
