Leasing a property to a tenant does not entitle the previous owner the right to continue to receive rent for the property. The same would stand to reason regarding the mineral rights. If they are leased to a company then the company is no longer in a legally binding "lease" because the previous owner was foreclosed on.

Mineral rights stay with the property unless they are "sold" not "leased" prior to the foreclosure.

Now if you don't have 10% down you will have to start seeking ways to fix your credit score and there are many, at least to get your credit score to 580 for you to pre-qualify for an FHA with 3.5% down.

We go down to 600 for VA loans, 620 for FHA, and 640 for USDA (without a credit waiver). But my first inclination would be to work on your husband's credit to help maximize your buying power. This can be easier than most people think if you work with am experienced Loan Officer. Let me know if you have any questions.

As far as security you can check any zip codes actual crime data @ www.city-data.com. lots of dogs normally does translate to noise. However best bet is go knock on some doors in the neighborhood.
