Most title companies have a disbursement letter that both deed holders would sign saying how the funds would be separated. I would suggest calling the title company your REALTOR is intending to use prior to putting your home on the market for confirmation. ... more

Excellent questions, the mineral right will automatically convey unless an agreement is signed by both parties. There is no relinguishment of these rights unelss agreed upon by both parties under any alottment of time. As the buyer you can show your intent to gain the mineral right by offering below asking price and attempt to pursued and or negotiate with the seller for those rights.

Are you still trying to sell? If so, I recently sold a home in N. Arlington to an investor whom had never even stepped foot in the home as he lives in New York and we did a long distance closing. It was a tear down and rebuild so there was no need for him to come to Texas. I know Arlington like the back of my hand and have sold properties quickly and for a good price in this down market.

Request the information from your mortgage company. The property records should be attached to your housing documents. If you want to get a good price for your land...DO NOT deal directly with the Oil and Gas companies. Find out who is running your local Homeowners Association. They will probably be negotiating with the different companies to get the best price per acre... Dealing with the company direct could see you getting $1k per acre and no royalties, while negotiating as a group could get you up to $25k and 25% royalty. I live in 76012 Sanford/cooper area and I know that Mt. Olive is negotiating on our behalf. Don't settle for less. ... more
