Sounds like you need your agent to be more responsive since the properties you like are moving so fast. I recommend having a conversation with your agent and getting on the same page. If you discuss this with your agent and the problem persists you may need to find another agent.

in regards to when the seller will choose the offer to accept there is no set time frame. Some seller's will pick right away and other times it may take days. It also depends on who the seller is. Is it a traditional sale, REO, short sale, etc.

105% LTV is a individual lender based requirement it is not a Fannie Mae or Freddie Mac requirement. Sounds like you are serviced by Freddie Mac based off looking for the avm (in freddie mac its refered to as the HVE Home Valuation Estimate)

My experience is that as long as the paint is not peeling you should be fine. If by indentations in it, your contractor means the old layers of paint that have been left from before, then that should not be an issue for financing. It might not look best visibly and you might consider capping it for visual appeal, but I wouldn't pay for that until it is closed and your house. I have heard of clients paying for work to get done to meet lender requirements, just to have the bank decide to back out of a deal after the work was done but before the home closed. A word of caution:

Be very careful financing multiple units in parts of Jeff Park. There are pockets of Jefferson Park that appear perfectly normal but have been hit hard by the foreclosure/short sale mess. What does this mean?

There are beautiful buildings that show good cap rates, but because the only comparables are $50k to greater than $100,000 less than asking price (and from distressed sales in different condition), you will find disbelieving owners unwilling to negotiate and lenders unwilling to lend without a sizable down payment.

Lesson: Before placing an offer, especially in Jeff Park (amongst other 'hoods), double check values despite a building being in good condition showing good income, if you plan on putting less than 20% down. Trust me, or you will waste money on an appraisal and two months of your time.
