You should really seek the advice of an attorney. Although the CC&R's could be poorly written, you need the advice of an attorney for interpretation. A court could interpret this differently. Did you purchase title insurance? Although a long shot, contact your title company or closing attorney to see if this affect on Title would constitute some advice from the title company's attorney.
