You might, as Karen indicated you were damaged. If they claimed to be qualified, went under contract with you under that pretense and then were caught not qualifying for a reason other than what a contingency in the contract may have permitted, you might have a claim to their earnest money.
Read the contract and discuss this with your agent. If you aren't sure either way after that, talk to an attorney.

BOA has a computer system set up, they usually resolve their short sales within 6 months, sounds like the sellers agent or negotiator may not be or know how to submit to Equator, if it has been submitted Your agent should start running up the list til they get a response from BOA. I have done this for my buyers on BOA with Equator and when they finally responded I threatened to have a press conference. It was not pretty but they did approve the deal within a week. (took 4.5 months total) I a just received a counter offer 7 months in on a offer submitted to my seller in October, meanwhile the bank wants the pool maintained, i told them to approve the deal and they would not have to worry about the pool, they countered $200 above contract price and cut our comissions to 5%...(If they had approved this at time of submission they could have save thousands in lost interest. Short sales are aggravating but they do eventually get done...Hang in there! ... more
