Selling inherited house to family members:
The house built in 2005 has just been sitting for 2 1/2 years, utilities left on, no one living in house 4 co-owners. I want too sell my co-ownership of property to existing family members and get out from under this debt. Last appraisal taken may 2013, $166,000.00. Family is making no decisions, how do I find out how much taxes and all other expenses will cost to submit an offer to sell ???

Hi Tnt723mon,

It depends on the loan program, what chapter you filed, whether or not you included a mortgage in the bk and the type of mortgage that was included.

1) FHA - Requires 2 years from the discharge on a chapter 7 unless you included a mortgage which is considered a foreclosure and requires a 3 year wait AFTER the sale of the property back to the bank unless you qualify under the Back To Work program. If you filed a chapter 13 BK, FHA will actually allow you to qualify 12 months into your bankruptcy.

2) VA - Requires a 2 year wait on a chapter 7 regardless of whether or not a mortgage was included. VA will also allow you to qualify 12 months into a chapter 13 BK.

3) USDA - Requires a 3 year wait on a chapter 7 and follows FHA & VA on a chapter 13 bk.

4) Fannie Mae - Requires 3 years from the discharge of a chapter 7 BK.
