Absolutely. She can buy the home in her name alone, but there's the question of the difference in value. He may owe more on the existing mortgage than the home is worth today and if so he would either need to get his lender to approve the sale and let him off the hook (unlikely but possible) or he'd need to write a check at the closing for the difference.... more
