1. There is the VRE Station that is on Brooke Road and that will take you down to DC/Union Station
2. Aquia Harbour, as a community, for example, has their own direct shuttle buses to the major points in DC, including the Pentagon
3. The slug line at the 610 lot is phenomenal also. If you have never slugged, most of the time, you can check with the drivers to see their destination hours. You do have to arrive early in order to catch the best available option.

Since time is of the essence, I would just list it at the price you want to sell it for. As long as you follow through with the window installation, I don't see the big deal. Closing a sale is going to take a while, so you should have plenty of time to finish the job. Just make sure you let prospective buyers know that you are replacing the windows.

You would think the proffers from the builders would have been partially distributed and 630 expanded before breaking ground (were any proffers designated for roads?). At least Colonial Forge had the additional lane added next to the turn lane, but still. What Irene says is true, too -- lot's of variables involved. It is also about supply and demand. Right now 22554 (Stafford) has about a 5 month supply of homes for sale (compared to 1.7 months supply in Fairfax County and 2 months in PW County). That means that Stafford is still a buyer's market (big supply/not much demand) and the northern counties are now experiencing a seller's market (in the lower price ranges which is currently Stafford's average price range).

On average, a new single family home in North Stafford will run into the upper 400s with minimal options, but average into the low to mid 500s for most buyers once the options are added. I'm referring to builders such as Beazer, Augustine, and Drees - they very nice new construction homes. Richmond American is slightly less. South Stafford, you have various options. DR Horton has a great community - 1 acre lots, but again you are looking at mid 500s. Fredericksburg is less (if you want to go further South). I deal in new construction and have built with 4 different builders myself between Stafford and Fredericksburg and just took clients out yesterday in fact looking at new construction. Don't go unrepresented to a builder - remember that the sales rep, while helpful, represents the builder. Make sure to have an agent represent your best interests. ... more

We're assuming your mother has spoken to bank representatives and attempted to modify her mortgage, or accept a cash for keys settlement from the bank. If she wants to sell the home though a short sale instead of losing it to foreclosure she should contact us and let us negotiate with her bank. Even with the auction fast approaching it's possible we could have it delayed in order to sell the home.

But to answer your question we need to explain the eviction process in Virginia. There should be an Unlawful Detainer notice posted to the door anytime. The bank has arranged for Stafford General District Court to issue the Unlawful Detainer Notice, and have a lower court judge to rule on legal ownership of the home, and remove residents without legal claim to occupancy during an unlawful detainer hearing. Once the Unlawful Detainer Notice is posted you will have at least 30 days to vacate the home or contest removal from the home.

A hearing date will be attached to the Unlawful Detainer Notice. During the unlawful detainer hearing, if there are no objections to a issuance of a Writ of Possession which will require all residents to vacate the property, a judge will rule possession to the plaintiff (bank). An Eviction Notice will then be posted on your mother's home. You then have at least 72 hours after the notice is posted, or the date chosen by the Sheriff's Office to vacate the home of face trespassing charges if you refuse to leave at the direction of law enforcement.

You will have an additional 10 days for automatic right of appeal the lower court decision to Circuit Court. If you don't appeal the initial decision, after 10 days have expired a Writ of Possession will be signed and issued by the lower court. The plaintiff is required to remove any remaining possessions to the nearest public curb. When this process starts depends on the date representatives (attorney) for the bank file for an unlawful detainer and set the hearing date.

If the lien was there when you purchased the property, you need to definitely check with the people who closed the loan to ask what was or wasn't paid at time of closing.

Not beyond the realm of possibility that if the lien was there from prior owner, it could have been paid at closing but not recorded.

You definitely need to seek professional assistance for this matter.

Here are two links for you to check and see if the loan is owned by FNMA or FHLMC. If it is you can refinance to at least 105% and maybe 125% But there are MANY restrictions on these loans. Does it have MI etc. When did you buy the house. Do you have a second mortgage etc?

If it's no on here then call your lender to ask. It's easy to ask them as well. They get the call all the time. I have seen the websites be wrong on occasion. You may wish to contact your current lender on a refinance also whether the loan is owned by FNMA or FHLMC or not. FHA is cappped at 97.75% for what you want to do not 85% That is the limit for cash out. Don't wait around these guidelines are getting tougher every day so if you have a borderline case get it in now before you miss the chance at these low rates.
