Determining the seller's authority to sell involves an investigation and a risk that most people handle with the purchase of title insurance. This transfers the risk of an unauthorized sale to the insurance company.

Another way to figure this out is to ask the seller to produce documents showing their authority to sell, which is not all that unreasonable, but which will simply duplicate what the title insurance company's work.

If you have a doubt based in fact, as opposed to being mere curious, ask your broker to document the seller's bona fides before you put your money down.

There really are not too many lenders who have this loan program available. If they do, it's a 80/10/10 loan, were you'll need a 10% down-payment and borrow 80% on one loan and the 10% on a second loan. Good luck.
